Summary of Bay Area Air Quality Management District’s July 30, 2008 Amendment of Regulation 9, Rule 7
Tune-Up Requirement: effective 1/1/2009
No person shall operate any boiler, steam generator or process heater rated at greater than 2 million BTU/hr unless they perform an inspection and tune-up at least once per calendar year or operate at less than 10% of annual maximum heat capacity.
Insulation Requirement: effective 1/1/2010
No person shall operate any boiler, steam generator or process heater rated at greater than 2 million BTU/hr unless the exposed, external surface of the device (excluding the stack) does not exceed 140°F, un-insulated, or 120°F, insulated.
Registration Requirements: Effective 1/1/2011
No person shall operate any boiler, steam generator or process heater rated at greater than 2 million BTU/hr unless the device is registered in accordance with Regulation 1, Section 410 or a permit to operate has been issued.
Stack Temperature Limits: Effective 1/1/2011
No person shall operate any boiler or steam generator rated at greater than 2 million BTU/hr with a stack temperature (downstream of any economizer) that exceeds:
- Firetube – the greater of 100°F over saturated steam temperature or 250°F over ambient temperature.
- Watertube – the greater of 150°F over saturated steam temperature or 250°F over ambient temperature.

Compliance with Emissions Standards – Devices rated at less than 10 MMBTU/hr heat input
The manufacturer shall obtain certification from the APCO that its boiler, steam generator or process heater has been independently tested and meets the emission limits described above. This does not apply to burner assemblies sold as retro-fit packages. |
